54 - Notifying Others of the Review

OVERVIEW
Section 54 requires the
Commissioner to provide a copy of the
request for a
review to the
head of the
public body and to any other person the Commissioner deems appropriate.

54 (1)
On receiving a request for a review, the
Commissioner must give a copy to
(a) the head of the public body concerned, and
(b) any other person that the commissioner considers appropriate.

PROCEDURE
The
public body and
Commissioner jointly review the request to determine whether the concerns raised by the applicant can be addressed through mediation.
The public body will initially be more familiar with the issues involved than the Commissioner. If the public body has any information concerning affected
persons who should be notified of the
review, the head conveys this information to the Commissioner’s office as soon as possible. The public body also relays any relevant issues, considerations or factors which affected the outcome of the request.

INTERPRETATION
The
Commissioner determines the procedures for conducting a review. However, the Act provides enabling provisions as well as some requirements that will influence the conduct of reviews.
Upon receiving a
request for a
review, the Commissioner must provide a copy of this request to the
head of the
public body and to any other
person the Commissioner deems appropriate.
