40 (1)
A commissioner appointed under
section 37(1) or
section 39(1) is entitled
(a) to be paid, out of the consolidated revenue fund, a salary equal to the salary paid to the chief judge of the Provincial Court, and
(b) to be reimbursed for reasonable travelling and out of pocket expenses personally incurred in performing the duties of the office.
(2) The Lieutenant Governor in Council may,
on terms and conditions the Lieutenant Governor
in Council specifies, order that the
Public Sector Pension Plans Act applies to the commissioner.
(3) If an order is made under subsection (2), the
Public Service Pension Plan applies subject to
subsection (4).
(4) When calculating the amount
of a pension under the Public Service Pension
Plan, each year of service as commissioner must
be counted as 1 1/2 years of pensionable
service.
