Privacy Protection Schedule (PPS)


Introduction

The PPS will help ensure that the high privacy standards set by the Freedom of Information and Protection of Privacy Act (FOIPP Act) are maintained for personal information held by contractors performing services for public bodies (as defined in the FOIPP Act).

 

Policy for ministries 

A Privacy Protection Schedule (PPS) must be completed and attached as a schedule to any contract between the government and a contractor that involves "personal information" as defined in the Freedom of Information and Protection of Privacy Act unless it is not intended that the public body will own or control the personal information.

A PPS must be in the form set out at in this document unless an alternative version has been authorized by the IM/IT Privacy and Legislation Branch (PLB), Ministry of Labour and Citizens' Services.

PLB will consider an alternative version only if, given the circumstances or context of the contract, it is necessary to change the PPS because the original wording does not apply to the situation under consideration.  Ministries submitting requests to PLB for authorization to use an alternative version of the PPS must explain in detail why it is necessary to make the changes.  In some instances, a particular section will not apply to the contracted service and in those cases elimination of the section may be considered.  However, if the section does apply to the contracted service, PLB will only consider changes that are equivalent to or better than the requirements of the original PPS.

Advice for other public bodies

The PPS for use by other public bodies may be completed and attached as a schedule to any contract between a public body and a contractor under which the contractor will be collecting, creating, using, disclosing or storing "personal information" (as defined in the FOIPP Act) unless it is not intended that the public body will own or control the personal information.

 

Procedure to access the PPS

The PPS is a one-page document in Microsoft Word 97 format or PDF format (for more information on using PDF click here) and it's intended to not be modified except for three fillable fields at the top of the page.
