Schedule 3 of the Freedom of Information and Protection of Privacy Act, R.S.B.C. 1996, c. 165, is amended by adding
"Building Officials' Association of British Columbia".

Section 3 (1) (c) of the Freedom of Information and Protection of Privacy Act, R.S.B.C. 1996, c. 165, is repealed and the following substituted:
- a record that is created by or for, or is in the custody or control of, an officer of the Legislature and that relates to the exercise of that officer's functions under an Act; .

Section 7 is amended
- by repealing subsection (1) and substituting the following:
- The advocate has the right to any information that
- is in the custody or control of a director or of a public body as defined in the Freedom of Information and Protection of Privacy Act, and
- is necessary to enable the advocate to perform duties or exercise powers or functions to the advocate given under this Act,
except information that could reasonably be expected to reveal the identity of a person who has made a report under section 14 of the Child, Family and Community Service Act. , and
- in subsection (2) by striking out "a public body" and substituting "A director or public body".

Section 3 (1) of the Freedom of Information and Protection of Privacy Act, R.S.B.C. 1996, c. 165, is amended by adding the following paragraph:(c.1) a record that is created by or for, or is in the custody or control of, the Children's Commission and that relates to the exercise of the commission's functions under the Children's Commission Act; .Commencement
37 This Act comes into force by regulation of the Lieutenant Governor in Council.

Section 2 of the Supplement to the Freedom of Information and Protection of Privacy Act, R.S.B.C. 1996, c. 165, is repealed and the following substituted:

- Section 1 (a), (b), (d) and (f) comes into force on January 1, 1997.
- Section 1 (c), (e) and (g) comes into force by regulation of the Lieutenant Governor in Council.

Section 89(5) is repealed and the following substituted:
- Sections 44 to 49, 54 to 57 58(1), (2), (3)(d), (4) and (5) and 59 of the Freedom of Information and Protection of Privacy Act apply in respect of a review requested under this section, except that a reference to a public body or to the head of a public body is to be read as reference to a director.

Section 40(2) of the Freedom of Information and Protection of Privacy Act, R.S.B.C. 1996, c. 165, is repealed and the following substituted:
- The Lieutenant Governor in Council may, on terms and conditions the Lieutenant Governor in Council specifies, order that the Public Service Pension Plan, continued under the Public Sector Pension Plans Act, applies to the commissioner.
- If an order is made under subsection (2), the Public Service Pension Plan applies subject to subsections (4) and (5).
- When calculating the amount of a pension under the Public Service Pension Plan, each year of service as commissioner must be counted as 1 ½ years of pensionable service.
- Despite the accrual of 35 years of pensionable service, contributions to the Public Service Pension Plan must continue for each additional year of service up to 35 years of contributory service.
